Our client was facing a claim from an employee alleging bullying and harassment against one of the company's managers. Following a full investigation, the allegations were demonstrated to be unfounded and that the allegations were made to divert attention away from underperformance; all of which was acknowledged by the solicitors acting on behalf of the employee.
Result: The company was saved from the expense and inconvenience of a tribunal hearing and the manager's work record remained unblemished.
Our client contacted us after trying to deal with a long term sickness issue on their own. They had taken advice from several solicitors but did not have the necessary expertise to effectively put the advice into action. By the time we were called in, the company was facing a claim for unfair dismissal (up to £50,000) which was threatening to escalate into a claim for disability discrimination (potentially unlimited!).
Result: we were able to negotiate a severance agreement settled at about one third of the original claim by the employee for unfair dismissal. The employee decided not to try to bring a claim for discrimination. Had we been brought in at the outset, the issues of unfair dismissal and discrimination could have been avoided altogether.
